Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Datawizz, Inc., doing business as Gamut (“Gamut,” “we,” “us,” or “our”) governing your access to and use of the Gamut website at gamut.so, the Gamut applications, the local agent runtime, and all related services (collectively, the “Service”).
By creating an account, installing the Gamut runtime, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
If you do not agree, do not use the Service.
1. The Service
Gamut lets you build, run, and collaborate with AI agents that perform real work on your behalf. Among other things, agents can:
- run in sandboxed containers on your computer or in environments you connect;
- operate a web browser and interact with websites, applications, and files;
- connect to third-party services through native APIs, MCP servers, and direct compute;
- be reached and directed through interfaces such as Slack, Telegram, and iMessage; and
- hand off tasks to one another and reuse skills, templates, and memory.
The Service is software and tooling. The agents act on instructions you configure and authorize. You are responsible for the tasks you direct agents to perform and for the consequences of those tasks, as described in Section 4.
2. Eligibility and Accounts
You must be at least 18 years old to use the Service. You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use or security breach. You are responsible for the conduct of every user, agent, and integration operating under your account or workspace.
3. Authorization to Act on Your Behalf
This is the core of how Gamut works, so please read it carefully.
3.1 Grant of authority. When you direct an agent to perform a task, including logging into a service, sending a message, completing a form, making a purchase, or otherwise acting through your accounts or credentials, you authorize Gamut and its agents to take those actions as your agent and on your behalf.
3.2 Your authority to grant access. You represent and warrant that you own, or have all necessary rights and authority over, every account, credential, system, dataset, and resource you connect to or instruct an agent to access, and that you may lawfully authorize automated access to them. You further represent that you have all rights, licenses, and permissions necessary to provide your Input and to have agents act on it.
3.3 Third-party terms. Many websites and services have their own terms that govern automated access, scraping, or actions taken by software agents, and those terms vary and change over time. You decide which third-party services your agents interact with and what they do there, and you are solely responsible for ensuring those tasks comply with the terms, policies, and applicable law that govern each third-party service. Gamut does not pre-screen, monitor, or warrant that automated access to any particular third-party service is permitted, and Gamut is not a party to and has no responsibility for your relationship with any third-party provider. Any exchange of data or transaction between you and a third-party provider is solely between you and that provider.
3.4 General-purpose tool. The Service is general-purpose automation tooling. Agents perform actions that you could perform yourself, at your direction and configuration. Gamut does not control, endorse, or independently verify the tasks you assign or the purposes for which you use the Service, and does not determine whether any given task, target, or use is appropriate or permitted. You are responsible for choosing how to use the Service and for the consequences of that use.
3.5 Review and control. Agent actions can be irreversible (for example, sending a message, deleting data, or completing a purchase). You are responsible for configuring appropriate permissions, approvals, and oversight. It is your responsibility to evaluate whether agent output and actions are appropriate for your use case, including where human review is appropriate, before relying on, using, or sharing them, particularly for sensitive or high-impact tasks.
4. Your Responsibilities and Acceptable Use
You are solely responsible for your inputs, your instructions to agents, and the agents’ resulting actions and outputs. You agree not to use the Service to:
- violate any applicable law or regulation, or infringe or misappropriate any third party’s intellectual property, privacy, or other rights;
- gain access to systems, accounts, or data that you are not authorized to access;
- send malware, or conduct phishing, fraud, or deceptive impersonation;
- launch denial-of-service attacks or otherwise deliberately overload, disrupt, damage, or impair the Service or any third-party system;
- generate or distribute unlawful or harmful content; or
- build, train, or benchmark a competing service using the Service.
This list addresses unlawful and abusive conduct; it is not a list of approved or disapproved use cases. As stated in Section 3, decisions about which third-party services your agents use, and whether a given task is consistent with those services’ terms, are yours to make and yours to bear responsibility for.
You must review and validate agent output before relying on it. AI-generated output may be inaccurate, incomplete, or inappropriate for your use case. Where agent output is delivered to other people (for example, through Slack, Telegram, email, or other interfaces), you must notify those recipients that factual assertions in agent output should not be relied upon without independent verification.
Responsibility for those you authorize. You are responsible for ensuring that everyone you permit to use the Service, and every agent and integration you configure, complies with these Terms. Their acts and omissions in connection with the Service are treated as yours.
Cooperation with compliance. You will cooperate with reasonable requests from Gamut to verify compliance with these Terms, including requests to confirm your identity and how you are using the Service.
5. Credentials, Connected Accounts, and Security
5.1 Local proxy. Where supported, credentials you connect are routed through a local proxy so that the agent runtime does not directly receive your secret keys. This is a security measure and not a guarantee; no method of transmission or storage is perfectly secure.
5.2 Sandboxing and permissions. Agents run in sandboxed containers with software-defined, scoped permissions. You are responsible for setting permissions appropriately for the sensitivity of the connected systems and tasks.
5.3 Audit logs. The Service may record agent actions for traceability. You are responsible for reviewing logs relevant to your compliance and oversight obligations.
5.4 Your environment. You are responsible for the security, maintenance, and lawful operation of the computers and environments on which you run the Gamut runtime and agents.
6. Your Data, Inputs, and Outputs
6.1 Ownership. As between you and Gamut, you retain all rights to the data, prompts, files, and other materials you provide (“Input”), and you own the results generated by agents based on your Input (“Output”).
6.2 License to operate the Service. You grant Gamut a limited, worldwide, non-exclusive license to host, process, transmit, and display your Input and Output solely to provide, secure, and improve the Service, and to take the actions you authorize.
6.3 Model training. We do not use your Input or Output to train our own foundation models. We rely on third-party AI model providers to deliver the Service, and we contract with them on terms intended to ensure that your content submitted through the Service is not used to train their foundation models. The applicable provider terms, and the sub-processor list referenced in Section 6.4, govern the handling of your content; to the extent a provider’s terms conflict with this Section, those terms control as to that provider. We do not warrant the data-handling practices of any third-party provider.
6.4 Sub-processors and AI providers. The Service relies on third-party infrastructure and AI model providers (see our Privacy Policy and sub-processor list at gamut.so/subprocessors). Your content may be processed by these providers solely to deliver the Service.
6.5 Feedback. If you give us suggestions or feedback, you grant us a perpetual, royalty-free license to use it without restriction.
7. Plans, Credits, Fees, and Renewals
7.1 Plans and credits. The Service is offered on free-trial, Pro, and Enterprise plans. Usage of agents, compute, and third-party models consumes credits or usage allowances as described at gamut.so/pricing. Free-trial credits have no cash value and may expire or be modified.
7.2 Subscriptions. Paid subscriptions bill in advance on a recurring cycle and automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method for all fees and applicable taxes.
7.3 Overages. Usage beyond your plan’s included allowance may incur additional charges at the then-current rates.
7.4 Fee changes. We may change fees or credit pricing with reasonable prior notice, effective at the start of your next billing cycle.
7.5 Refunds. Except where required by law, fees and consumed credits are non-refundable.
8. Intellectual Property
The Service, including its software, models, interfaces, and content (excluding your Input and Output), is owned by Gamut and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, non-sublicensable right to use the Service in accordance with these Terms. You may not copy, modify, resell, reverse engineer, or circumvent the technical protections of the Service except as permitted by law.
9. Third-Party Services and Integrations
The Service interoperates with third-party services, APIs, MCP servers, and websites that we do not control. We are not responsible for their content, availability, security, or practices, and your use of them is governed by their terms. We may suspend or remove an integration at any time.
10. Beta and Experimental Features
We may offer features identified as beta, preview, or experimental. These are provided “as is,” may change or be withdrawn, and may be less reliable. We may make them opt-in or opt-out with notice.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMUT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT AGENT ACTIONS WILL BE CORRECT OR COMPLETE, OR THAT OUTPUT WILL BE ACCURATE. YOU BEAR THE RISK OF USING AUTONOMOUS AGENTS, INCLUDING THE RISK OF UNINTENDED OR IRREVERSIBLE ACTIONS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMUT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY ACTION TAKEN BY AN AGENT. GAMUT’S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO GAMUT FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You will defend, indemnify, and hold harmless Gamut and its affiliates, officers, and employees from any claims, losses, and expenses (including reasonable legal fees) arising out of: (a) your Input or Output; (b) your use of the Service; (c) tasks or actions you directed agents to perform; (d) your violation of these Terms or applicable law; or (e) your violation of any third party’s rights or terms, including any third-party service accessed by an agent at your direction.
14. Suspension and Termination
We may suspend or terminate your access, with or without notice, for breach of these Terms, non-payment, security risk, or to comply with law. You may stop using the Service at any time. On termination, your right to use the Service ends. We will make your data available for export for thirty (30) days after termination, after which it may be deleted. Sections that by their nature should survive (including Sections 4, 6, 7, 8, 9, 11, 12, 13, and 15) survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot first be resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules (and, where applicable, its Consumer Arbitration Rules), rather than in court. The arbitration will be conducted in Delaware, or remotely where the parties agree, and may proceed on a documents-only basis where the AAA rules permit. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual claim in small-claims court for disputes within that court’s jurisdiction, and either party may seek injunctive or equitable relief in court to protect its intellectual property or confidential information. To the extent any dispute is found not subject to arbitration, the parties submit to the exclusive jurisdiction of the state and federal courts located in Delaware.
Class-action waiver. You and Gamut agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one party’s claims and may not preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim, and only that claim, will be severed and may proceed in court.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new “Last updated” date or notifying you in-product). Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree, stop using the Service.
17. General
These Terms, together with any referenced policies (including the Privacy Policy), are the entire agreement between you and Gamut regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
